Many times parties will know what property they want to transfer and will opt to forego title examination and act of sale. In those instances Assurance Title provides document drafting services. Our focus in this work is to verify the documents are legally sound, and accurately reflect the parties' directives, accomplishing their directed goal.

1. The preparation of the Deed is one of the most critical legal services, as this document transfers ownership from the seller (grantor) to the buyer (grantee).

  • Legal Description Accuracy: Assurance Title uses the information provided by the parties to ensure the deed contains the exact provided legal description as well as the provided grantor and grantee information to accomplish the stated goals.

  • Vesting: We confirm that the grantors (sellers) and the grantees (buyers) are listed exactly as directed and with the directed tenancy to take title (e.g., as joint tenants, tenants in common, or an LLC).

  • Execution & Recording: We then prepares the deed, ensures it is signed correctly, notarized according to state law, and then officially recorded in the county public records to finalize the transfer.

When preparing directed deed Assurance Title does not provide legal advice. We are executing the instructions given by the parties and the contract.

2. Owner Finance Document Preparation
In an owner-financed transaction (where the seller acts as the bank), Assurance Title's role expands to preparing the necessary documents to establish and secure the seller's loan interest as directed.

  • The Promissory Note: Assurance Title prepares the Promissory Note, which outlines the loan's financial terms, including the principal amount, interest rate, payment schedule, and terms for default.

  • The Deed of Trust: We prepare the security instrument (Deed of Trust in Mississippi). This document legally gives the seller the right to foreclose if the buyer fails to repay the loan as defined in the Promissory Note.

  • Vesting and Liens: The title company ensures the security instrument is properly signed, notarized, and recorded immediately after the deed is recorded. This guarantees the seller's lien is legally established as the first lien (or agreed-upon priority) against the property.
