Title Opinion

Title Opinions are order more often by lenders than current owners or prospective purchasers but a Title Opinion can be ordered and issued to anyone.

A Title Opinion is a formal assessment and legal opinion provided by our attorney based on the findings of the title examination. Our Title Opinions include the following:

• Owner Certification: The Title Opinion recites who the current owner or owners are and sources their ownership claims.

• Verifies Marketability: It will state whether the owner has a marketable title—one free from legal issues that would prevent the transfer or affect the property's use.

• Identifies Defects: It will highlight any issues found, such as outstanding mortgages, tax liens, boundary disputes, or improperly recorded documents.

• Verification of Search Elements: Our Title Opinions detail exactly what was searched and for what time periods those items were searched. It will also detail the items that title exams cannot or typically do not search and document. We do this so you will have no confusion as to what information you have and what information must be obtained from other sources.
